Terms of sale

1 · The seller

These terms govern sales concluded on www.seymr.fr, by WhatsApp, by email and by named quotation. The seller is Lucas Seymour JEAN, sole trader (entrepreneur individuel, EI), trading as SEYMR®, registered with the Basse-Terre trade register under number 902 423 698, SIRET 902 423 698 00023, whose address is C/o SBH DOM, Carrefour Les 4 Chemins, 51 route de Marigot, 97133 Saint-Barthélemy, France.

2 · Scope

These terms apply to every order, to the exclusion of any other terms. Rules specific to consumers are flagged in each article; article 12 sets those applying to professional buyers. Placing an order means accepting the terms in force on that date.

3 · The pieces

Each edition is described on its page: materials, dimensions, number of copies, lead time. Editions are made to order in London by a single partner workshop that produces in-house, to the specification set by the House. Original works from the corpus are transferred by private agreement, on consultation; they are not sold online.

Visuals are photographs or renderings of the piece. Printing on textile, leather or paper allows slight colour variations between screen and material, and a tolerance of 1 to 3 % on dimensions. These variations come from production and are not defects.

The workshop may use a material of at least equivalent specification, without altering the essential characteristics stated on the page.

4 · Prices

Prices are in euros, including any applicable taxes, excluding delivery. Delivery charges are shown before payment. They do not add up: only the highest delivery charge in the order applies.

The applicable price is the one displayed when the order is placed. Import duties and taxes levied outside the European Union, and local taxes levied in French overseas territories, may remain payable by the recipient (article 7).

5 · Ordering

Orders are placed with the “Acquire” button on the page, which opens a secure payment page, or by WhatsApp and email. Above €2,000, acquisition goes through a named quotation issued to the buyer.

The contract is formed when the buyer receives the House’s written confirmation, sent after payment. The chosen personalisation (initial, number, word) and, for the Paper print, the number of the chosen work form part of the order.

The House may verify the buyer’s identity and payment details, and refuse an order where fraud or an unresolved earlier dispute is suspected.

6 · Payment

Payment is due on ordering, by card or Apple Pay on the payment page of Stripe, a licensed payment provider, or by bank transfer for a named quotation. The House never has access to full card details.

7 · Production and delivery

The order is passed to the workshop on the working day it is confirmed. Most pieces are made and shipped within 2 to 3 working days, then delivered according to destination: lead times and carriers are on the Production and delivery page. Where no date is given, delivery takes place no later than 30 days after the contract is concluded.

Delivery is tracked and handed over against signature. For consumers, the piece travels at the House’s risk until it is handed over. An inaccurate or incomplete address supplied by the buyer may lead to re-delivery at the buyer’s expense.

If delivery exceeds the stated date or lead time, the consumer may require the House to deliver within a reasonable additional period, then terminate the contract if delivery does not occur within it, as provided by the French Consumer Code.

8 · Cancellation

Any order may be cancelled free of charge within 30 minutes of its confirmation, by WhatsApp or by email. The refund is then initiated within 24 hours.

After that, production has started. A personalised piece or a professional order may still be cancelled before shipping, subject to a 20 % deduction covering materials and work already committed. If production is complete, the deduction may be higher, on written justification.

A consumer ordering a non-personalised piece keeps the right of withdrawal in all cases (article 9).

9 · Right of withdrawal

Consumers have 14 days from receipt of the piece to withdraw without giving any reason (article L221-18 of the French Consumer Code). The decision is notified by an unambiguous statement, by email to contact@seymr.fr or using the form at the end of this page.

The piece is returned no later than 14 days after notification, complete, unused, in its original packaging, to the address given by the House. Return costs are borne by the consumer, who is liable for any loss in value resulting from handling beyond what is needed to establish the nature, characteristics and functioning of the piece.

The House refunds all sums paid, including standard delivery, within 14 days of notification, using the original means of payment. The refund may be withheld until the piece is received or proof of its dispatch is provided.

Exception. The right of withdrawal does not apply to pieces made to the consumer’s specifications or clearly personalised (article L221-28, 3°), including a piece bearing an initial, a number or a word chosen by the buyer.

10 · Defect, damage, lost parcel

Manufacturing defect

A scratch, a stitching or hem fault, or a printing or material defect present on delivery is repaired, remade or refunded at no cost. The House asks for it to be reported within 14 days of receipt, before anything is sent back, with the order number and clear photographs: the whole piece, a close-up of the defect, the label or packaging. This period organises handling; it does not reduce the legal guarantees (article 11).

Transit damage

If the outer packaging is badly damaged, delivery may be refused. Any damage is reported within 48 hours of delivery, with photographs, the packaging being kept until resolution. The piece is remade at no cost or refunded in full.

Lost parcel

Three working days after the estimated delivery date, the buyer reports the delay with the order number. If the carrier declares the parcel lost, the piece is remade and re-shipped at no cost, or refunded in full within 14 days. A parcel lost because of an inaccurate address supplied by the buyer does not give rise to this right.

No return is accepted without the House’s prior agreement, which gives the address and shipping method. Return costs for a defective piece are refunded once the defect is confirmed.

11 · Legal guarantees

Consumers benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code), independently of any other guarantee.

Legal guarantee of conformity

The consumer has two years from delivery of the piece to act, and during that period does not have to prove that the lack of conformity existed at delivery. The consumer obtains conformity through repair or replacement, free of charge; failing that, a price reduction or termination of the contract.

Guarantee against hidden defects

The action may be brought within two years of discovering the defect. The buyer chooses between termination of the sale and a price reduction.

The House offers no commercial guarantee beyond the legal guarantees.

12 · Professional buyers

Professional buyers have no right of withdrawal. Risk passes to them when the piece is handed to the carrier. Manufacturing defects are handled under article 10 and cancellation follows article 8. The House’s liability is limited to the invoiced amount of the order concerned, save for gross negligence or wilful misconduct.

13 · Liability

The House is not liable for non-performance attributable to the buyer, to the unforeseeable and insurmountable act of a third party, or to force majeure (article 16). Nothing in these terms limits the rights consumers hold under the law.

14 · Intellectual property

The works, Les Huit Opérateurs®, the visuals, the texts and the SEYMR mark belong to the House. Acquiring a piece transfers no reproduction or exploitation right. Any reproduction without written consent is prohibited.

15 · Personal data

Data needed for the order is processed under the privacy policy.

16 · Force majeure

An event beyond the reasonable control of the House or its workshop suspends the obligations it affects: natural disaster, epidemic, conflict, government action, strike, network failure, cyberattack, carrier delay. If the delay exceeds 30 days, either party may cancel the order; sums paid for an undelivered piece are refunded.

17 · Mediation, disputes, governing law

In case of difficulty, the buyer first writes to the House, which seeks an amicable solution.

Under article L612-1 of the French Consumer Code, consumers may refer the matter free of charge to the consumer mediator to which the House belongs: [mediator to be appointed: name, address, website].

These terms are governed by French law. Consumers may bring proceedings before any court the law makes available to them. For professional buyers, jurisdiction lies with the courts within the Basse-Terre Court of Appeal.
